Job Description

Accountability Cluster

Major Activities / Tasks

I. Work in a team to cater to business requirements and to serve as a legal contact for all transactional documents and ensure adherence to specific laws and regulations

  • Provide adequate legal support to the internal team in drafting, reviewing the contract
  • Co-ordinate with the business stakeholders and centers of excellence such as taxation, insurance, corporate, admin, company secretarial team, finance etc. to ensure that the business practices and procedures being followed are in line with applicable laws & legislation
  • Respond to queries in relation to existing contract obligations and revisions and provide the required advisory.
  • Coordinate with the specific business teams to validate accurate business understanding in the contract documents
  • Adhere and maintain the TAT set for the business team in timely closure of the transaction documents
  • Ensure adherence to the internal company policies and processes
  • Prioritize the workflow based on business priorities
  • Create and provide a regular report on the workflow to the business teams

II. Conduct legal research and litigation support

  • Collate the facts and information required by the internal litigation team from the business teams.
  • Work closely with the internal legal excellence teams
  • Conduct legal research to ascertain the existing provisions of various acts and regulations

III. Implement, Monitor & Maintain the Indian Compliance with applicable laws for all activities

  • Compliance with applicable laws and guidelines: Drugs and Cosmetics Act and Rules, Drugs and Magic Remedies (Objectionable Adv.) Act, FFSAI act, Legal Metrology Act and Rules, UCPMP, MCI etc.
  • DPCO 2013 Compliance: Ensue sale of all products are sold and launched at the notified price and in compliance with DPCO 2013.
  • Risk Management: Identify risk factors and adopt best practices and working toward zero risk manufacturing and sale of products.
  • Marketing: Ensure all the marketing activities are done in compliance with laws. Advice marketing team in doing right advertising and promotions within the legal framework.
  • Due Diligence: undertake DD and assist finance and M&A team in analyzing the risk in the transaction.
  • SOP for all marketing and label approvals : Define standard operating procedure for marketing and label approvals to marketing teams.
  • Promotional Material and Sponsorship Programs: Ensure that all the promotional material and sponsorship programs comply with the laws and applicable regulation and UCPMP.
  • Audit : Conduct periodic audits on the process and implement new and robust process by way of automation to avoid any duplication and overcharging for marketing spends.
  • Litigation: Manage legal notices and litigation with HQ.
  • Contract Management: Manage all the contracts and implement SOP for execution and storing of all agreements, notices and other legal documents

IV. Ensure compliance with policies and procedures, applicable laws and contractual obligations in the contracts

  • Coordinate with the commercial contracts Centre of excellence team to draft, review and negotiate contracts in line with the business requirements.
  • Coordinate with internal and external team to resolve the issues relating to non-compliance of applicable laws pertaining to the manufacturing units across India.
