About the Position

As Employment & Labor Counsel you will primarily support AML RightSource's legal and human resources departments, provide ad-hoc legal research and analysis, as well as take on compliance projects as necessary within the entire global organization.

You will be expected to advise and negotiate issues involving employment law related issues, dispute resolution and litigation, data privacy and data security law related issues, complex customer contracts involving employee screening and background check requirements, and compliance law related issues, ultimately providing a variety of general employment & labor legal services to the organization and its in-house clients. The ideal candidate will have excellent communication skills as they will be interfacing with cross-functional teams and external customers.

Primary Responsibilities

  • Expert to advise the business needs for HR Compliance related to Labour Laws, Provident Fund, State Insurance (as applicable) etc. and advising on resolutions for concerns raised
  • Experience advising on and ideally managing recurring requirements defined under Secretarial and Legislative needs such as Shops and Establishment, Safety, Health etc. This includes managing registrations and filing compliance reports as and when required under government norms
  • Experience liaising with local administration and authorities to align with local laws and functions
  • Assisting with HR investigations as needed and monitoring for regulatory/statutory compliance, preparing reports as needed
  • Preparing and presenting HR Statutory/Compliance related workshops for the employees and the business to understand the necessities of any amendments made by the state governing body
  • Develop and facilitate training to increase awareness of regulatory compliance in the organization
  • Advise and coordinate with Internal Information Security team, Operations and Legal departments as and when required
  • Assist in the review, drafting, and negotiation of complex commercial contracts or other legal documentation with customers, suppliers, and others who desire to contract with the Company with respect to matters relating to employment and labor compliance, employee background check/screening requirements, and other local compliance matters..
  • Provide legal and strategic business advice to ensure agreements are consistent with internal corporate policies and processes.
  • Support the General Counsel in serving as an advisor and business partner across the company by providing counsel and guidance for accomplishing AML RightSources overall business objectives.
  • Provide legal guidance around data privacy and data security law related issues.

Required Qualifications

  • A Juris Doctor from a recognized law school plus an active bar membership in India.
  • 7+ years of relevant legal experience (from a combination of law firm, government, and/or in-house experience) in the area of employment law.
  • Ability to work with diverse teams through complex negotiations, keeping all tasks organized and stakeholders clearly informed of deliverables and timelines.
  • Ability to understand business objectives and think creatively and outside-the-box to find resolutions to achieve requirements of all parties.
  • Commercial contracting and data privacy and security experience.
  • Ability to support AML RightSource teams globally across multiple time zones.
  • Occasional travel to other AML RightSource offices in Delhi, Noida, Kolkata, or Gurugram, may be required from time to time.

Preferred Qualifications

  • Prior law firm or in-house experience supporting multinational corporations headquartered in the U.S. a plus.
  • Experience drafting and negotiating Managed Service Provider and/or Software as a Service (SaaS) contracts a plus.
